1、Australia Launches Anti-Circumvention Investigation on Chinese Coil Anti-Dumping Case

On 9 May 2024, the Australian Anti-Dumping Council (ADC) issued Notice No. 2024/029, stating that it had initiated an anti-circumvention investigation into the anti-dumping case of China’s rod in coil in response to an application filed by InfraBuild (Newcastle) Pty Ltd, an Australian domestic enterprise. The investigation was conducted to examine whether steel coil imported from China had been slightly altered into steel bars with a carbon content of less than or equal to 0.20 per cent by weight, which had been exported to Australia to circumvent existing anti-dumping measures. The description of the products involved is as follows: grids, nets and fences, welded at the intersection, of metal wires having a maximum cross-sectional dimension of 3 millimetres or more and a mesh size of 100 square centimetres or more. The Australian Customs code for the product in question is 7314.20.00.24.The period of investigation in this case is from 1 January 2015 to 31 March 2024. It is expected that the Australian Commission will issue a basic factual report no later than 27 August 2024 and submit a final recommendation to the Australian Minister for Industry and Science and Technology no later than 11 October 2024.

2、The U.S. ITC issues partial determination on passive optical network equipment

On May 9, 2024, the U.S. International Trade Commission (ITC) announced a partial final determination (Part 337) concerning specific passive optical network equipment (Investigation Code: 337-TA-1384). The decision upheld the administrative judge’s initial ruling (No. 12) issued on April 10, 2024, which was not subject to review. This was due to the failure of Chinese companies Hangzhou Softel Optic Co., Ltd., Hangzhou DAYTAI Network Technologies Co., Ltd., and Hangzhou Sumlo Industrial Co., Ltd. to respond in a timely manner, resulting in their absence as named respondents.

On May 8, 2024, the U.S. International Trade Commission (ITC) released a public announcement regarding specific outdoor and semi-outdoor electronic displays and their downstream products and components (Investigation Code: 337-TA-1331). The decision involved rejecting the applicant’s request for reconsideration and not reviewing the final determination of non-infringement for products found not to infringe.

4、The U.S. ITC issues partial determination on graphic systems and components, and digital televisions containing the system

On May 7, 2024, the U.S. International Trade Commission (ITC) announced a partial final determination (Part 337) concerning specific graphic systems and components, and digital televisions containing the system (Investigation Code: 337-TA-1318). Following review, requests for reconsideration from named respondent Realtek, explanations from applicant AMD regarding why Realtek should not be subject to measures or required to submit supplemental responses, and requests from Realtek to submit a defense were all denied. Additionally, a temporary request from AMD to submit supplemental responses was rejected.

5、Australia initiates second sunset review on anti-dumping and countervailing duties on Chinese deep drawn stainless steel sinks

On May 6, 2024, the Australian Anti-Dumping Commission announced the initiation of the second sunset review on anti-dumping and countervailing duties on deep drawn stainless steel sinks imported from China. The investigation period spans from April 1, 2023, to March 31, 2024. The Australian Customs code for the products is 7324.10.00.52. The commission anticipates releasing the essential facts report by August 26, 2024, and submitting final recommendations to the Minister for Industry and Technology by October 8, 2024.

6、The U.S. initiates first sunset review on anti-dumping and countervailing duties on alloy aluminum sheet

On May 7, 2024, the U.S. Department of Commerce issued a notice stating the initiation of the first sunset review on anti-dumping and countervailing duties concerning imported alloy aluminum sheet from China. The preliminary determination indicates that if the current anti-dumping measures were revoked, it would lead to continued or renewed dumping of Chinese products at a rate of 59.72%. Similarly, in the event of revocation of countervailing duties, subsidies on Chinese products would continue or recur at rates ranging from 48.46% to 57.00%.

7、The U.S. initiates third sunset review on anti-dumping and countervailing duties on circular welded carbon-quality steel pipe

On May 1, 2024, the U.S. Department of Commerce issued a public announcement initiating the third sunset review on anti-dumping and countervailing duties concerning circular welded carbon-quality steel pipe imported from China. Interested parties are required to register their participation with the U.S. Department of Commerce within ten days of the publication of this notice. Additionally, stakeholders are instructed to submit response comments to the International Trade Commission by May 31, 2024, and provide final comments on the adequacy of responses no later than July 9, 2024.

On May 1, 2024, the U.S. Department of Commerce issued a notice initiating the first sunset review on anti-dumping and countervailing duties concerning glycine imported from India, Japan, and Thailand. Concurrently, the International Trade Commission (ITC) initiated the first sunset review on anti-dumping and countervailing duties on glycine from China and India. Interested parties are required to register their participation with the U.S. Department of Commerce within ten days of the publication of this notice. Additionally, stakeholders are instructed to submit response comments to the International Trade Commission by May 31, 2024, and provide final comments on the adequacy of responses no later than July 9, 2024.

9、Brazil adjusts scope of anti-dumping duties on Chinese truck and bus tires

On May 2, 2024, Brazil’s Foreign Trade Chamber announced Resolution No. 583 of 2024, which expands the scope of anti-dumping duties to include tire components with rim sizes of 20 inches, 22 inches, and 22.5 inches under tariff codes 8716.90.90, 8708.70.10, and 8708.70.90 originating from China, South Korea, Japan, Russia, and Thailand. These measures will be in accordance with Resolutions No. 198 and No. 176 of 2021 and are effective immediately upon publication.

10、The U.S. issues preliminary determination on anti-dumping duties on aluminum extrusions

On May 2, 2024, the U.S. Department of Commerce announced a preliminary determination on anti-dumping duties concerning aluminum extrusions imported from China, Colombia, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, South Korea, Thailand, Turkey, the United Arab Emirates, Vietnam, and Taiwan. The preliminary dumping rate for Chinese producers/exporters is determined to be 4.91% (adjusted to 0.00% for non-subsidized companies), while the rate for non-cooperative companies is 376.85% (adjusted to 365.19% for non-subsidized companies).

11、Mexico makes sunset review determination on anti-dumping duties on alloy carbon steel pipes from China

On April 30, 2024, the Mexican Ministry of Economy announced its decision regarding the sunset review of anti-dumping duties on alloy carbon steel pipes originating from or imported from China. The Ministry decided to maintain the existing anti-dumping duties as determined in the original ruling, continuing to impose duties ranging from $0.356 to $0.618 per kilogram. These measures took effect on March 9, 2023, and will remain in place for a period of five years. The products in question include straight-seam alloy carbon steel pipes with circular, square, and rectangular cross-sections, falling under Mexican tariff codes 7306.19.99, 7306.30.03, 7306.30.04, 7306.30.99, and 7306.61.01. The announcement became effective the day after its publication.

12、The EU initiates second sunset review on anti-dumping and countervailing duties on organic coated steel products from China

On April 30, 2024, the European Commission announced the initiation of the second sunset review on anti-dumping and countervailing duties concerning organic coated steel products originating from China. This action was in response to a request submitted by the European Steel Association (EUROFER) on February 2, 2024. The review will assess whether the cancellation of existing anti-dumping and countervailing measures would result in continued or renewed dumping and subsidies harming the EU domestic industry.

13、Colombia initiates anti-dumping investigation on galvanized and galvanized aluminum-zinc coil sheets from China

On April 30, 2024, the Ministry of Commerce, Industry, and Tourism of Colombia published Announcement No. 115 of April 26, 2024, initiating an anti-dumping investigation on galvanized and galvanized aluminum-zinc alloy coil sheets originating from China. The products under investigation fall under Colombian tariff codes 7210.41.00.00, 7210.49.00.00, 7210.61.00.00, 7210.69.00.00, 7225.92.00.90, and 7225.99.00.90. The announcement became effective the day after its publication.

14、Colombia makes anti-dumping determination on suspension PVC from China

On April 30, 2024, the Ministry of Commerce, Industry, and Tourism of Colombia issued Announcement No. 108 of April 24, 2024, regarding the anti-dumping investigation on suspension PVC originating from China and the United States. The Ministry decided to terminate the anti-dumping investigation and not impose anti-dumping duties on the products from China and the United States. The products in question fall under Colombian tariff code 3904.10.20.00. The announcement became effective the day after its publication.

15、India imposes safeguard measures on low ash metallurgical coke

On April 29, 2024, the Indian Ministry of Commerce and Industry issued a notice regarding safeguard measures on imported low ash metallurgical coke. The Ministry recommended the implementation of safeguard measures for a period of one year, restricting the import quantity of the concerned products. The products in question are metallurgical coke with an ash content below 18% falling under tariff code 2704, excluding coke powder/dross and ultra-low phosphorus metallurgical coke with a phosphorus content of up to 0.030%, a size of 30 millimeters, and a size tolerance of 5%, used for the production of ferroalloys.

16、South Korea initiates second sunset review on anti-dumping duties on oriented polypropylene film from China

On April 26, 2024, the South Korean Ministry of Economy and Finance issued Announcement No. 2024-107 (Case Investigation No. 23-2024-3), initiating the second sunset review on anti-dumping duties concerning oriented polypropylene film (OPP) with a thickness exceeding 10 micrometers imported from China, Indonesia, and Thailand. The investigation period for dumping spans from January 1, 2023, to December 31, 2023, while the injury investigation period extends from January 1, 2020, to December 31, 2023. Chinese companies involved in the investigation include Jiangsu Shukang Packing Material Co., Ltd., Guangdong Decro Package Films Co., Ltd., Anhui Guofeng Plastic Industry Co., Ltd., Zhongshan New Asia Adhesive Products Co., Ltd., Zhejiang Kinlead Innovative Materials Co., Ltd., and Suzhou Kunlene Film Industries Co., Ltd. The existing anti-dumping duties remain in effect during the investigation period. The final ruling is expected to be issued within six months, unless extended (up to four months).

17、South Korea makes affirmative determination on sunset review of anti-dumping duties on coniferous wood plywood from China

On April 18, 2024, the Korea Trade Commission issued Announcement No. 2024-9 (Case Investigation No. 23-2023-7), making an affirmative determination on the second sunset review of anti-dumping duties on coniferous wood plywood with a thickness equal to or greater than 6 millimeters originating from China. The Commission recommended the continuation of the anti-dumping duties for a period of five years, with a uniform rate of 7.15%. The implementation of these measures is subject to relevant announcements by the South Korean Ministry of Economy and Finance. The products under investigation fall under South Korean tariff codes 4412.39.9000 and 4412.99.9100.
